Is delta-8 THC legal?
Delta-8 THC is legal depending on where you are. At the federal level in the US, delta-8 THC is not defined as a controlled substance. Similar to CBD, delta-8 was placed into a legal loophole by the 2018 Farm Bill that made the compound legal as long as it contained less than 0.3% delta-9 THC by dry weight volume. While delta-8 is tolerated by the federal government, the Federal Analog Act prohibits analogs of any controlled substance, such as THC. However, this act has yet to be enforced. Some states have restrictions or bans on delta-8 THC products. As many as a dozen states have limited sales or possession of delta-8.
